The tasks of the Ministry of Foreign Affairs in the field of control of exports of military material are defined in Act No. 38/1994 concerning foreign trade in military material. The MFA does not issue export licences (export licensing falls within the competence of the Licensing Authority at the Ministry of Industry and Trade). The MFA merely gives or denies its consent from the perspective of foreign policy.
During the licensing procedure under Act No. 38/1994, the MFA examines licence applications in the light of the Czech Republic´s foreign policy as well as security interests and obligations, including the criteria of the EU Code of Conduct on Arms Exports. All licence applications concerning deliveries to countries such as Georgia are scrutinized in this manner.
The key principle of the scrutiny is to prevent exports of arms
that might be misused in interstate or internal conflicts or for
human rights violations, as well as exports that might result in
undesirable spreading or unauthorized re-exports of arms.
