Family member of an EU citizen

Visa procedures for the short stay of Family Members of EU Citizens (up to 90 days)
 

I. Who is a family member of an EU citizen?

A family member of an EU citizen is a family member of a citizen of any of the EU country or Iceland, Lichtenstein, Norway and Switzerland, who is a:

  1. spouse,
  2. parent if it concerns someone who supports an EU citizen under 21 with whom they live in a common household,
  3. child under 21 or such a child of the spouse of an EU citizen and
  4. dependent direct relative in an ascending or descending line or such a relative of the spouse of an EU citizen.

A dependent person is understood to be a third-country national supported by a European Union citizen or the spouse thereof who:

  1. is systematically preparing for a future profession up 26 years of age;
  2. cannot systematically prepare for a future profession or perform gainful activities due to illness or injury; or
  3. is not capable of performing systematic gainful activities due to a chronic adverse health condition.

A family member of an EU citizen can also be understood to be a foreign national who can credibly prove that:

a) they are a relative of an EU citizen that is not specified above if:

  1. they lived in a common household with an EU citizen in the country whose citizenship they hold or in the country in which they held long-term or permanent  residence;
  2. they are supported by an EU citizen; or
  3. they cannot care for themselves without the personal care provided by an  EU citizen due to a chronic adverse health condition; or

b) they are in a permanent relationship with an EU citizen that is comparable to a family relationship and that they share a common household.

The provisions of the Act on Residence of Foreign Nationals pertaining to family members of European Union citizens will be also be applied to a foreign national who is a family member of a citizen of the Czech Republic

II. Short-term stay (up to 90 days)

The visa application for family members of EU nationals is free of charge and should be submitted in person. The general processing time is 14 days, but it might be extended up to 45 days from the lodging of your visa application for first time appliers. Especially if the supporting documentation is not sufficient. You will have to prove your relation to the EU citizen and his/her EU citizenship by original of the relevant document - Czech or European marriage certificate. In case there is a common child, an original of Czech or European Birth Certificate shall be submitted. Documents from other EU countries must be superlegalized (or with an Apostille where applicable) and officially translated to Czech language.

In case of missing proof of the EU citizen identity and the family relationship, the applicant cannot be considered to be a family member of an EU citizen and standard rules of procedures will be applied.

1. Visa Requirements

 

Family members of EU citizens who wish to apply for short-stay visa (Schengen) are only required to submit:

1- a valid travel document + photocopy

2 - fully completed and signed Schengen visa application form.  Please note: the application form must be filled in only in Czech or English language. The application form can be filled electronically or manually.

3 - document proving that the applicant is a member of the family of an EU Citizen - original + photocopy.

4 - photocopy of passport/ or ID of EU Citizen (data page) together with his/her original written consent (dated and signed) that he/she agrees with the use of this photocopy for official use by the Czech Embassy. (Souhlasím s pořízením kopie pro úřední účely ZÚ     ČR. Datum:... Podpis:...).

5 - 1 colour photograph not older than 3 months.

6 - Copy of round-trip flight ticket or flight reservation (with valid reservation code or with number of ticket, if already paid).

ADDITIONAL DOCUMENTS MAY BE REQUIRED REGARDING THE PURPOSE OF TRAVEL.

IT IS UP TO THE VISA APPLICANT TO PROVE THAT HE IS A BENEFICIARY OF THE DIRECTIVE 2004/38/EC. HE MUST BE ABLE TO PROVIDE DOCUMENTARY EVIDENCE FORESEEN ABOVE AS HE MUST TO BE ABLE TO PRESENT EVIDENCE TO SUPPORT HIS CLAIM.

2.  Make an appointment

 

Please note that if you are a family member of an EU citizen, you are entitled to a priority appointment to submit your application at the Embassy of the Czech Republic in Cairo.

The email must include information about the APPLICANT:
1. A scan of the data page of the travel document in pdf format;
2. A scan of the document proving your relation with Czech citizen in pdf format -  marriage or birth certificate
3. A scan of the document proving citizenship of principal

3. Appeal Procedure

 

The procedure in case of the visa refusal is the same for family members as for any other Schengen visa applicants. The request for an appeal must be lodged within 15 days of the receipt of visa refusal via the diplomatic mission, at which the visa application has been filed. The appeal should include the name of the applicant and describe the reasons, why the applicant considers the refusal decision to be in contrary to the law. The Ministry of Foreign Affairs will review the request in 60 days from the receipt of the appeal. The information on the outcome of the review is sent to the applicant via the same diplomatic mission.

To hand over your appeal you should approach the Embassy from Sunday through Thursday between 2:00 pm - 3:00 pm ONLY.

The important difference for EU family members is the right for further appeal to the court. Thus, the negative outcome from the Ministry of Foreign Affairs can be appealed at the respective administrative court (Municipal Court in Prague). The appeal to the Municipal Court in Prague should be in writing within 30 days to its address: Městský soud v Praze, Hybernská 18, 111 21 Praha 1, Czech Republic

Kindly note that because of the protection of personal data the status of the visa application cannot be disclosed to anyone but the applicant.
