Who is a family member of an EU Citizen Who is a family member of an EU Citizen
A family member of an EU citizen is a family member of a citizen of any of the EU country or Iceland, Lichtenstein, Norway and Switzerland, who is a:
- spouse,
- parent if it concerns someone who supports an EU citizen under 21 with whom they live in a common household,
- child under 21 or such a child of the spouse of an EU citizen and
- dependent direct relative in an ascending or descending line or such a relative of the spouse of an EU citizen.
A dependent person is understood to be a third-country national supported by a European Union citizen or the spouse thereof who:
- is systematically preparing for a future profession up 26 years of age;
- cannot systematically prepare for a future profession or perform gainful activities due to illness or injury; or
- is not capable of performing systematic gainful activities due to a chronic adverse health condition.
A family member of an EU citizen can also be understood to be a foreign national who can credibly prove that:
a) they are a relative of an EU citizen that is not specified above if:
- they lived in a common household with an EU citizen in the country whose citizenship they hold or in the country in which they held long-term or permanent residence;
- they are supported by an EU citizen; or
- they cannot care for themselves without the personal care provided by an EU citizen due to a chronic adverse health condition; or
b) they are in a permanent relationship with an EU citizen that is comparable to a family relationship and that they share a common household.
Requirements
- visa application form
- form must be filled in completely
- form must be signed twice (2x) on page 3 - at item no. 37 and at the bottom
- photo must be glued into the correspondent space in the upper right corner of the first page
- do not fill in "multiple" number of entries unless you qualify for such a visa (please, leave in blank in case of doubt)
- 1x recent color photograph (3,5 x 4,5 cm or 2 x 2 inch)
- entire face must be clearly visible
- white background
- good print quality on high quality photo paper, made at professional photo studio
- passport
- validity must extend at least three months after the intended date of departure from the Schengen territory
- must contain at least two blank pages
- must be issued within the previous 10 years
- copy of the passport
- 1 copy of the data/photo page
- document proving the legal status in US
- valid US visa + I-94 departure record
- valid Alien Registration Card (Green Card)
- students must submit the original validated I-20, DS-2019 or IAP-66
- US residence permit or visa must be valid at least 3 months beyond the intended date of departure from the Schengen territory
- copy of the valid US visa or Green Card + copy of all the previous Schengen visas
- 1 copy of each
- document confirming the status of a family member of EU citizen
- original or notarized copy of Czech marriage certificate (in the case of a spouse) or Czech birth certificate (in the case of a child)
- original or notarized copy of US marriage certificate (in the case of a spouse) or US birth certificate (in the case of a child)
- passport of the EU Citizen - original or a notarized copy
- visa fee is free of charge
- document confirming that you are accompanying the EU Citizen or planing to join him/her in the Schengen State of destination
- trackable prepaid self-addressed USPS Priority Mail Express envelope
- only in case the applicant needs the passport to be mailed back and cannot pick up the passport personally at the Consulate
- the Consulate is not responsible for any losses and the applicant must deal directly with the mailing company
- please, fill in your own address or the address of the Consulate as "sender/from" on the self-addressed envelope
- we cannot accept FedEx or any other mailing company not stated above
