Collection of your personal data on the visa application form, including collecting photograph and fingerprints, is mandatory for the examination of the visa application. Visa application cannot be successfully examined without the your personal data.

The legal basis for personal data collection and processing is set out in Regulation (EC) No 767/2008 (VIS Regulation), Regulation (EC) No 810/2009 (Visa Code) and Council Decision 2008/633/JHA.
The scope of responsibility of the Ministry of Foreign Affairs for personal data processing is set out in Section 166 (3) of the Act on Residence of Foreign Nationals: Ministry of Foreign Affairs is responsible for processing of personal data provided by the applicant who applies for a Schengen visa at the consulate of the diplomatic mission of the Czech Republic.
The scope of responsibility of the Alien Police Service for personal data processing is set out in Section 167a (1) of the Act on Residence of Foreign Nationals Alien Police Service is responsible for processing of personal data provided by the applicant who applies for a Schengen visa at external borders.
Personal details will be provided to the competent authorities of other Schengen Area Member States for the purpose of deciding on your visa application.
These data, as well as data relating to the decision on your application or the decision to annul, revoke or extend the visa granted, will be entered in the Visa Information System (VIS), where they will be stored for a maximum of five years. During this time period, personal data may be accessed by visa authorities and authorities carrying out visa checks at the external borders and on the Schengen Area territory, immigration and asylum authorities for the purpose of verifying compliance with the entry and residence conditions, identifying persons who do not or no longer meet these conditions, for assessing asylum applications and for determining who is competent for such assessment. Under certain conditions, personal data can also be made available to other designated authorities in the Schengen Area and to Europol for the purposes of prevention, detection and investigation of terrorist offences and other serious criminal offences (Council Decision 2008/633/JHA).
Your personal data may also be shared third countries or international organizations for the purpose of proving identification of third-country nationals, including for the purpose of their return. This may only take place under specific conditions.* You can contact the respective Czech authority responsible for personal data processing for information how these conditions are observed in your specific case.
[Under the GDPR** and the VIS Regulation***, you are entitled to access to your personal data, including its copy, as well as the identification of the Schengen Area Member State which transmitted the personal data to the VIS. You also can request that your personal data, if inaccurate or incomplete, are corrected or made complete or that their processing is limited – under certain conditions or that they are erased, if processed unlawfully.]
You may address your request for access, correction, limitation or erasure directly to the authority responsible for processing the data in the Czech Republic (see contact details above). Further details on how you can exercise your rights, including the related remedies under the national law of the country concerned, are available on the website and can be provided upon request.
You can also address any individual Schengen Area Member State to find out what information it stores in the VIS. A list of competent authorities and contact details for sending such request are available on the website of the Personal Data Protection Office.
You are also entitled to lodge a complaint with a national supervisory data protection authority of any Schengen Area Member State, in particular of the Member State of the alleged infringement, if you suspect your personal data were processed unlawfully.
