The Meeting of Council of Europe Committee of Legal Advisers on Public International Law (CAHDI) took place in the Czech Republic for the first time

 

A regular meeting of the CAHDI was held for the first time in the Czech Republic on September 24 and 25, 2020, and due to the COVID-19 pandemic was in a hybrid mode, so many delegates participated via internet. In his opening speech on Thursday, September 24, 2020, Mr. Martin Smolek, Deputy Minister of Foreign Affairs, highlighted the uniqueness of this pan-European forum where legal advisers of Council of Europe Member States as well as observers exchange ideas and best practice in international law. Mr. Smolek recalled that the Council of Europe has always played an important role in the Czech foreign policy, based on the respect for rule of law and human rights. Mr. Smolek also addressed the current situation caused by COVID-19 pandemic and the questions that arose with respect to international law in the areas such as protection of human rights, diplomatic law and law of international organisations.
 

Mr. Petr Válek, Director of the International Law Department of the Ministry of Foreign Affairs, was elected the Chair of CAHDI in 2018 and now serves his second-term in this position. Apart from current issues of international law, the participants of the CAHDI meeting discussed among others questions related to immunities of States and international organisations, law and practice relating to reservations and interpretative declarations concerning international treaties or developments concerning international criminal tribunals and international humanitarian law. The CAHDI members and observers exchanged views with two special guests. Judge Ekaterina Trendafilova, President of the Kosovo Specialist Chambers (KSC), informed about the establishment of the KSC and its mandate, as well as current indictments. Mr. Klaus Rackwitz, Director of the International Nuremberg Principles Academy, gave a speech on the occasion of the 70th anniversary of the adoption of the Nuremberg Principles by the International Law Commission.

The 59th CAHDI meeting was preceded, on September 23, 2020, by a CAHDI Seminar on the Contribution of the European Court of Human Rights to the Development of Public International Law. Among speakers were Mr. Linos-Alexander Sicilianos, Judge and former President of the ECtHR, Prof. Pavel Šturma, Chairman of the International Law Commission, and Prof. Georg Nolte, Member of the ILC. Concluding remarks were presented by Mr. Emil Ruffer, Permanent Representative of the Czech Republic to the Council of Europe. The seminar was organized on the occasion of the 70th anniversary of the conclusion of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
