Application for a marriage registration – a marriage that took place in Canada

This application is submitted when a Czech citizen marries in Canada. Sometimes it is submitted along with an application to determine Czech citizenship and issue Czech citizenship certificate when a child is born during this marriage.
 

Based on this application, you will be issued a Czech marriage registration and your marital status will be updated. If applicable, surnames of the spouses will be also updated.
Marriages of Czech Republic citizens that took place abroad are registered by zvláštní matrika in Brno-střed.

 

The following must be submitted: 
Please note: All documents must be originals. Copies of documents, excluding those certified in the Czech Republic, cannot be accepted. 

  1. Completed form: Žádost o zápis uzavření manželství.
  2. Original marriage certificate in the form of certified copy of marriage registration (long-form). Marriage certificate can also be accepted. To obtain the certificate, you must contact the appropriate provincial authority: 
    Ontario: Service Ontario
    Alberta: Vital Statistics Alberta
    Manitoba: Manitoba Vital Statistics Agency
    Saskatchewan: eHealth Saskatchewan

Please note that we are unable to accept religious documents or a record of solemnization of marriage. Occasionally, we are unable to accept provincial certificates issued a long time ago as the authentication authorities may not authenticate them.  

         3.The original (NOT a notarized copy) must be affixed with a certification called Apostille by the  appropriate government authority – this depends on where the marriage certificate was issued:

 

          4.   Along with the original marriage certificate affixed with an Apostille you will submit a professional translation into Czech language. The translation must be done on a computer on a separate sheet of paper and the entire document must be translated – this includes the Apostille.The translation does not have to be notarized. We do not accept translation by automated translators.  For your convenience, the Consulate lists contacts for several translators in Canada on its website

         5.  An applicant’s proof of Czech citizenship – valid Czech passport, valid obcansky prukaz, valid Czech citizenship certificate or completed application and questionnaire to determine Czech citizenship and to issue Czech citizenship certificate with the accompanying documents for this type of application. If both spouses are Czech, they both must submit proof of citizenship.

          6.Birth certificates of spouses – Czech citizens (birth certificates of foreigners are not typically requested except for spouses who were born in the Slovak Republic). 

        7. Divorce certificate of previous marriage with the date the divorce took a legal effect if any of the spouses entered into marriage is divorced. Please note that the divorce must be legally recognized in the Czech Republic; this means the divorced Czech citizen must already be recorded as divorced in the Czech Republic. Please contact us for more information beforehand if a Czech citizen divorced in Canada and the divorce has not been documented in the Czech Republic as well.  It maz be necessary to have the divorce recognized in the Czech Republic first before submitting this application.

         8. Death certificate of the previous spouse if any of the spouses entered into the marriage is a widow/widower.

         9. Completed form: Osobní údaje.

Important information regarding the surname agreement (Dohoda o příjmení)

Canadian marriage certificate do not contain any surname agreement; therfore in case of registering a marriage that took place in Canada, please fill out the appropriate part in the  section Není uvedena na cizozemském oddacím listu.

The spouses are to make the agreement according to the Civil Code ( sections 660-662).

Children can only be named after one of the parents. It is not possible to make an agreement to combine parents´ last names for the children´s  last names. (in general, this is only possible in cases where one of the parents already has a compound last name).

Should the woman wish for her last name to be recorded in the male version without the suffix -ová, this can be indicated on the application form in the relevant section.

You can also request to have  your last name recorded in a way that is not in accordance with  the Civil Code as indicated above but instead according to the section 70 of the Vital Registry Act provided you submit a valid picture ID or a confirmation certificate issued by a government authority with an issuance date after the date of marriage.
